These terms and conditions apply to the use of this website and by using the website you are legally bound by them.

It is important that as a website user you periodically check these terms and conditions because we reserve the right to change them at any time without notice. The terms and conditions that are available on our website at the time you are using it will be those that apply during such use.

General terms of use

A valid home mailing address must be supplied during the ordering process, as all other addresses will not guarantee delivery. PO Boxes or Club Addresses are not acceptable. Should you supply a PO Box or Club address, FP Music will not be responsible for non-delivery of items purchased.

You are only permitted to play music you have ordered through this site under the specified terms and conditions of BMI licensing.

Re-recording (dubbing) music from its original format, on to cassette CD, mini disc, mp3 players or any digital recording devices is strictly prohibited.

We may include hyperlinks on this site to websites or resources operated by parties other than FP Music, including advertisers.

FP Music is not responsible for the content or accuracy of any external links, nor are we responsible for the availability of such external websites or resources and do not endorse and are not responsible or liable, directly or indirectly, for the privacy, practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources. FP Music is not responsible for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.

Your order

Item prices shown are inclusive of any postage, handling, delivery, or tax charges unless otherwise specified.

All orders placed online with fitpromusic.com are subject to our order acceptance information detailed below.

Accepting an order

Order acceptance and the completion of the contract between you and us will take place when we mail the product/item ordered, unless we have notified you that we do not accept your order or you have cancelled it in accordance with the cancellation instructions.

Occasionally we are not able to accept orders and these are the most common reasons:

  • We do not have the item(s) in stock
  • We are unable to get authorisation for your payment
  • There has been some kind of pricing or product description error

Your order will be sent as soon as:

  • Payment has been authorised
  • The item is in stock

If there is any problem with your order we will contact you immediately.

Delivery

We will always aim to fulfill your shipment three to five working days from the date of your order approval.

You have not received your order

If you have not received your item within 10 working days of placing your order, please contact our Customer Services Department via email at orders@fitpromusic.com

Privacy

FP Music collects information about an individual when the individual volunteers this information. For example, personal information may be gathered from the ordering process, catalogue requests or emails. This information will not be used for internal marketing and sales purposes without the approval of the user at the time of collection. This information may be sold or otherwise transferred to unaffiliated third parties only if approval for internal marketing from the user has occurred at the time of collection. This information will only be shared with other related organisations with whom FP Music has a trusted relationship and share common goals and who meet FP Music's criteria for sharing such information. When the information is collected the user will have the opportunity to "opt out" of receiving promotional and/or marketing information about other products or services from FP Music and/or any third parties. FP Music reserves the right to contact a user regarding product orders and other matters relevant to the underlying service and/or the information requested.

Information or files sent to FP Music technical support or sent through the technical support request system integrated into the fitpromusic.com site may also be used for internal marketing and sales purposes or be sold or otherwise transferred to unaffiliated third parties if the above criteria is met.

FP Music reserves the right to perform statistical analysis of user behaviour and characteristics. This information may be used to measure interest in and use of the various areas of the site. FP Music reserves the right to inform advertisers of such data analysis as well as the number of users that have been exposed to or clicked on their advertising banners. FP Music will only provide aggregated data from these analyses to third parties.

Upon request, FP Music will allow any user to "opt out" of further contact at any time.

FP Music will take reasonable care to keep the details of your order and payment secure. However, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Orders placed with third party sites are not the responsibility of FP Music and are subject to the order conditions of the third party site. Please ensure that you read the third party's site terms and conditions prior to ordering goods.

Methods of payment

You can pay by:

  • Visa and Visa Electron
  • MasterCard
  • American Express

fitpromusic.com does not accept the following payment methods:

  • Cheques
  • Money Orders
  • Gift Vouchers (fitpromusic.com vouchers accepted)
  • Cash
  • Other Credit Cards

It is important that you provide the cardholder name, expiry date and the last three digits of the security number found on the back of your credit card. We also require your credit card mailing address exactly as it appears on your card statement and a shipping address if different from the credit card mailing address. PO Boxes and club addresses are unacceptable mailing addresses. Card fraud is illegal and perpetrators will be prosecuted in all cases.

Cancelling your order

You may cancel your order at any time until seven-working days after delivery. (Please note that we may charge you to return the item and items or orders cancelled after the seven day period may incur a restocking fee).

If you have not yet received your item(s) and you wish to cancel please email us immediately at orders@fitpromusic.com giving as much detail as possible.

You must provide the following details to us:

  • Customer name
  • Mailing address
  • Email address
  • FP Music Membership No
  • Order number
  • Date of order
  • CD(s) title

Sometimes, by the time that you tell us you wish to cancel, we may have already sent your order. If so, remember that you must take care of the goods and return them to us in saleable condition.

FP Music reserves the right to charge you for any additional delivery costs.

Refunds

Due to the ease of copying this form of material we cannot offer an exchange or refund on CDs unless they are faulty.
If your product is faulty then a replacement of the same title will be despatched free of charge.

If you wish to claim a refund on your order, please send us an email ( orders@fitpromusic.com ) explaining the reason why your payment should be refunded. Do not send the goods back to us yet. When FP Music has received your email, we will look into the reasons for your refund request immediately. We will then get back to you with more information.

You may be asked to send the item(s) back to us.

When you send your item(s) back to FP Music, we will process the returned item and then notify you via email of the refund. You can expect a refund in the same form of payment originally used for the purchase and usually within four weeks of us receiving your return. If your purchase was by credit card, your refund should appear on your next statement.

You will be notified by email of completed returns and refunds. If the refund does not appear on your bank statement after four weeks from the day you sent us the return, please contact orders@fitpromusic.com for further assistance.

Note: fitpromusic.com will not generate refunds for items purchased from any hyperlinked sites.

Items returned because they are damaged, defective or incorrect

If we agree to refund or exchange an item under this category, we will check the item(s) on receipt. In the event that we find no fault, we reserve the right to charge you for the item(s) and to recover our fees and expenses from you.

Items returned within the seven-day cooling off period

You have the right to withdraw from the purchase of an item within seven working days of the day after the date the item(s) is/are delivered.

Description of products/goods

Each product is sold subject to its Product Description which may set out additional specific conditions relating to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after sales service and guarantees.

We take all reasonable care to ensure that all the details on product or goods descriptions are accurate. However, FP Music and/or fitpromusicshop.com accept no responsibility for errors or omissions.

Limitation of liability

While FP Music will use all reasonable efforts to verify the accuracy of any information it places on the site, it makes no warranties, whether expressed or implied, in relation to its accuracy. This site is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether expressed or implied, in relation to this site, or any transaction that may be conducted on or through this site including, but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that this site will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through this site.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether expressed or implied, in relation to the products available through this site including, but not limited to, implied warranties of satisfactory quality and fitness for a particular purpose. Nothing in these terms and conditions shall limit your rights as a consumer under US or English law.

By using this site, you acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of this site and any information provided to or taken from this site by you.
